NEST IN PEACE JABRICK

JABRICK has had her ups & downs since coming to COP Borneo. If you remember in Feb 2015 JABRICK who was only 1yr old was stolen from her Mum at the time her Mum was killed. JABRICK was very skinny & weak and the ‘owners’ realised they did not know how to care for such a young baby and so surrendered her. JABRICK was severely malnourished as she had only been given condensed milk and because an orangutan baby in the wild can suckle from their Mother for up to 8yrs was also denied many antibodies normally absorbed from Mum’s colostrum.

When JABRICK first arrived it took many months to bring her health up but the COP Team did increase her health and although only a baby she was one of the top climbers in forest school and often would not come down at the end of the day. Then JABRICK, whose defenses (because of the reasons mentioned above) were low caught Malaria and got really sick. She was removed from the cages and put in the temporary clinic and was under the constant care of the COP Borneo vet. She was sick for quite a few weeks but then slowly recovered and went back to Forest School where she was the orangutan who would climb the highest and not want to come down each day, she was top of her class even though she was the baby of the group.

Two weeks ago she caught influenza so had to again be removed from the cages and was taken to the temporary clinic whilst I was there. She was kept warm and Dr Iman tried everything to get her to eat as she had lost her appetite. When she wouldn’t eat enough Jabrick was given intravenous food and was monitored 24hrs a day. A a big orange teddy bear was bought for her so she could cling to it in her little basket in the clinic while she slept. Her condition continued to weaken as she would not eat or drink and finding veins to intravenously feed became increasingly difficult. Sadly on 15th January she passed away. We are all absolutely devastated as she was one of our little champions. RIP Jabrick, we will never forget you.

CASE REVIEW #16HAWKTRADER

Ditreskrimsus POLDA Est-Java has arrested Paska on July 4, 205 with 16 hawks as evidence in details of 1 javanese hawk (spizaetus bartelsi), 1 eagle (Nisateus Cirrhatus), 1 sea eagle (Halicetus leucogaster), 4 kestrel falcon, 2 eagle pups and 4 other dead hawks. Paska trades the eagles on Facebook.

CASE REVIEW Number 2167 / Pid.B / 2015 / PN.Sby

The Judge has stated that the defendant has been legally and convincingly proven committing the punitive measure “to have protected animals alive without legal rights from the authorities”.  Again, we are all facing the problem of ownership or legal rights on having protected animals. The enforcement of Minister of Forestry’s Regulation on plant and animal breeding Number.: P.19 / Menhut-II / 2005 and The Directorat General on Forest Protection and Nature Conservation’s Circulation Letter Number. SE.2 / IV-Set / 2009 on the issuance of permission to breed protected wildlife 2nd generation (F2) and so on has raised the community perception that commercializing protected wildlife is legal if we have the license. The second generation wildlife and so on were also considered to be not protected due to the regulations.

Furthermore, the judge sentenced the defendant to be imprisoned for 7 (seven) months and a fine of Rp. 2.500.000, – (two million five hundred thousand rupiah) subsidiary 1 (one) month in prison. Considering the Article 40 paragraph (2) and Article 21 paragraph (2) letter a and b of UU No. 5 1990 that owning protected wildlife should be threatened with confinement imprisonment of 5 years and a maximum fine of Rp 100.000.000, 00, this verdict was too light so as not to give deterrent effect to the defendant and protected wildlife collectors. In addition, the judge also did not state that the defendant is proven trading protected wildlife which could incriminate the penalties and give a deterrent effect to the defendant and the society in order stop the protected wildlife commercialization and ownership. REVIEW KASUS #PEDAGANG16ELANG

Pada 4 Juli 2015, Ditreskrimsus POLDA Jatim menangkap tangan Paska dengan barang bukti 16 (enambelas) ekor elang dengan rincian 1 (satu) ekor elang jawa (spizaetus bartelsi), 1 (satu) ekor elang brontok (Nisaetus Cirrhatus), 1 (satu) ekor elang laut (Haliacetus leucogaster), 4 (empat) elang alap, 2 (dua) ekor anak elang dan 4 (empat) ekor elang lainnya mati. Paska menjual burung-burung elang ini melalui situs Facebook.

REVIEW KASUS No.2167/Pid.B/2015/PN.Sby

Dalam Putusannya, Hakim menyatakan bahwa terdakwa telah terbukti secara sah dan meyakinkan melakukan tidak pidana “Tanpa Hak memiliki, memelihara satwa yang dilindungi dalam keadaan hidup tanpa disertai surat ijin dari pihak yang berwenang”. Kembali kita semua dihadapkan dengan permasalahan ijin kepemilikan atau pun memelihara satwa yang dilindungi. Berdasarkan Peraturan Menteri Kehutanan No.: P.19/Menhut-II/2005 tentang Penangkaran Tumbuhan dan satwa dan Surat Edaran Dirjen PHKA No. SE.2/IV-Set/2009 tentang penerbitan ijin penangkaran satwa liar dilindungi generasi ke-2 (F2) dan seterusnya, dengan diberlakukannya peraturan tersebut terbentuklah persepsi di masyarakat bahwa satwa liar dilindungi dapat dikomersialisasi selama memiliki ijin yang dimaksud. Keberadaan peraturan tersebut memberi anggapan bahwa satwa liar generasi ke-dua dan seterusnya bukanlah satwa liar dilindungi.

Lebih lanjut, Hakim memvonis terdakwa dengan pidana penjara selama 7 (tujuh) bulan dan denda sebesar Rp. 2.500.000,- (dua juta lima ratus ribu rupiah) subsidair 1 (satu) bulan penjara. Vonis ini terasa terlalu ringan sehingga tidak memberi efek jera bagi terdakwa maupun para penggiat hobi koleksi satwa liar dilindungi. Mengingat dalam Pasal 40 ayat (2) Jo Pasal 21 ayat (2) huruf a dan huruf b UU No. 5 Tahun 1990, bahwa memiliki dan memelihara satwa liar dilindungi diancam dengan kurungan penjara paling lama 5 Tahun dan denda maksimal Rp. 100.000.000,-. Dalam putusannya, hakim juga tidak menyatakan bahwa terdakwa terbukti memperniagakan satwa liar dilindungi yang tentunya dapat lebih memberatkan hukuman yang harus diterima oleh terdakwa dan membuat efek jera bagi terdakwa maupun bagi masyarakat agar kedepannya tidak ada lagi perniagaan, kepemilikan dan pemeliharaan satwa liar dilindungi. CHAIN OFF OF GIBBON, WHEN WE CARE

Elin Alvita is a member of Orangufriends Banjarbaru who is also an alumni of COP School Batch #5. Seeing the three long-tailed monkeys, two monkeys, a bornean gibbon and the Tongtong stork which lived in a low welfare at Van Der Pijl Park Banjarbabaru, Elin took the initiative to make improvements. It was not easy, but the Orangufriends and she got a huge support and were finally able to help the animals to get a better life.

Getting license from the Department of Sanitary and Landscaping Banjarbaru, Elin made a huge effort to raise fund by selling bornean gibbon t-shirt and organizing music concerts Fund for Park on September 26, 2015. In this fund-raising, Elin got both moral and material support from various communities and bands that toned up this event. The communities that have helped Elin were Morning Art Media Creative, WALHI South Kalimantan, Mapala Piranha, and Butze Tako. Meanwhile, the bands that have enliven the Fund for Park were Soul Cry, Sunday High Club, Hello Kitty Berkumis, Jokes of Superboys, Dreamtree Reggae, Seven Ways To Sunday and Buddy Guy Project. Aside from the community and the band, Elin also got financial support from Rumah Makan Semua Senang, Oasis Adventurous Stuff, and the donors who have bought the bornean gibbon t-shirts. From the donations and activities, Rp 8,923,800.00 where collected to be used in repairing the animal enclosure at Park Van der Pijl Banjarbaru.

The enclosure repairing was done in in October and December. The intentions were to remove the chain on animals’ stomachs and to better the animals’ life. In addition to fixing the cage, information boards about animals were also added to enrich the visitor information about the animals. This effort really helped the animals in the Van Der Pijl park to get its’ welfare. This couldn’t be done without the support of various parties mentioned above. Therefore, Elin and Orangufriends Banjarbaru would like to thank them all. (KIA)

RANTAI PUN LEPAS DARI OWA, SAAT KITA PEDULI

Elin Alvita adalah anggota Orangufriends Banjarbaru yang juga merupakan alumni COP School Batch #5. Berangkat dari keprihatinannya melihat rendahnya kesejahteraan tiga monyet ekor panjang, dua beruk, satu Owa Kalimantan dan satu bangau Tongtong di Taman Van Der Pijl Banjarbabaru, Elin berinisiatif melakukan perbaikan. Hal ini tidak mudah dilakukan. Akan tetapi berkat dukungan dari berbagai pihak, akhirnya Elin bersama Orangufriends Banjarbaru yang lain berhasil membantu satwa-satwa tersebut untuk mendapatkan kehidupan yang lebih layak.

Setelah selesai mengurus perijinan ke Dinas Kebersihan dan Pertamanan Banjarbaru, Elin melakukan penggalangan dana dengan menjual kaos bergambar Owa Kalimantan dan menyelenggarakan konser music Fund for Park pada tanggal 26 September 2015. Dalam penggalangan dana ini, Elin banyak mendapatkan dukungan baik moral maupun material dari berbagai komunitas dan band-band yang mengisi acara ini. Komunitas bekerja suka rela membantu Elin adalah Morning Art Media Creative, Walhi Kalsel, Mapala Piranha, dan Butze Tako. Sementara itu, band yang memeriahkan acara Fund for Park di antaranya Soul Cry, Sunday High Club, Hello Kitty Berkumis, Jokes of Superboys, Dreamtree Reggae, Seven  Ways To Sunday dan Buddy Guy Project. Selain dari komunitas dan band, Elin juga mendapatkan bantuan material dari Rumah Makan Semua Senang, Oasis Adventurous Stuff, dan donator-donatur yang membeli kaos Owa. Dari donasi dan kegiatan tersebut, terkumpul dana sebesar Rp 8.923.800,00 yang kemudian digunakan untuk memperbaiki kandang satwa di Taman Van der Pijl Banjarbaru.

Perbaikan kandang dilakukan dalam dua bulan, yaitu pada bulan Oktober dan Desember dengan target satwa yang dirantai di perut bisa dilepaskan dan satwa bisa lebih nyaman di dalam kandang. Selain memperbaiki kandang, papan informasi mengenai satwa juga ditambahkan untuk memperkaya informasi pengunjung mengenai satwa-satwa yang ada di Taman Van Der Pijl. Berkat inisiatif Elin tersebut, satwa-satwa di Taman Van Der Pijl dapat hidup lebih sejahtera. Keberhasilan Elin dalam menggerakkan Orangufriends Banjarbaru untuk memperbaiki kesejahteraan satwa-satwa tersebut tentunya tidak terlepas dari bantuan dari berbagai pihak yang telah disebutkan di atas.
